| | Effective April 12, 2012 the Selling Broker Commission Addendum should be included with all contract packages for contract areas 1A and 2A. The purpose of this form is notify the Selling Broker that any and all commissions earned on a sale are paid by HUD on the HUD-9548 sales contract. The Selling Broker is restricted from charging the buyer any further commissions. However, if the Selling Broker chooses to enter into an agreement strictly with the buyer, he/she may use an Exclusive Buyer's Agreement form. The use of this form indicates that the Broker will accept their commission to be paid strictly from the buyer. Therefore, the Broker is not allowed to be paid any commission on HUD's sales contract and line 6(a) of HUD form 9548 must reflect zero (0). A Selling Broker is not allowed to collect a commission from HUD on the sales contract, and also from the buyer, under a separate contract.
This form is not necessary for GNND sales.
